San Jose is located ....
San Jose is located at the northern part of Cebu City around 14 kms from the Cebu City Hall. It is bounded by Barangay Talamban at the south, Barangay Bacayan and Butuanon River at the East, Barangay Pulangbato at the North and Barangay Budla-an at the West. It has around 300 has jurisdictional lot area and composed mostly of mountainous and hilly terrain. Around 14% of its total land area is of plain terrain and occupied by households and religious structures. Thus the remaining 85% of total land area is idle and have no road accessibility. The barangay is classified as Rural Residential Zone by the City Assessors Office and most of its locators are of religious communities, thus not a few times was it described as the little Jerusalem in the Philippines.........

HISTORY ON THE CREATION OF BARANGAY SAN JOSE

(Excerpt from the accounts of expert witnesses who were present and who have participated in the process of the creation of Barangay San Jose) - First Barrio Captain Rolando Basirgo, Public School Teacher Ms. Lilia C. Bontuyan, Lupon Coordinator Jesus Borces and Brgy Councilor Edgardo Borces.
 
BARRIO SAN JOSE, before its creation into a new barrio, was considerably a remote hilly terrain comprised by the five (5) sitios of Barrio Talamban, namely: 1) Sitio Panuayon, 2) Sitio Kapangi-an, 3) Sitio Kantumagsing, 4) Sitio Tigbao (Sun-ok) and 5) Sitio Bolho. A substantially populated community that is geographically situated on the outskirts of Barrio Talamban. Unfortunately, it has no roads , electricity and piped water system due to its a far-off location that can only be accessed through existing footpaths or carabao cart trails. The people communing in this area felt being neglected by the leadership and officials of it's original barrio (TALAMBAN) in terms of public services and facilities. The concentration of projects and developments like roads, thoroughfare, waterworks system and electricity were then only devoted on the "poblacion" plains of the Barrio Center.  Sometime in 1971, Mrs. Lorenza Borces with her close friend and companion, Mrs. Melitona Colina, initiated the idea of consolidating the five (5) sitios to form into one barrio that is separate and distinct from that of Barrio Talamban under the following justifications;
:To enable the new barrio to secure for itself new roads and other public service facilities, precisely for the progress and enhancements to the lives of it's constituents;
:To secure distinct governmental budget appropriations for health services, education, as well as other economic incentives under the city-wide development plan of the Cebu City government.
:To obtain faster development for basic needs such as public roads, electricity and water system.
These two proponents initiated the holding of the historical meeting among concerned constituents in a chapel at "Sitio Panuayon" that was owned by the late Agapita "Pitang" Tudtud-Catunggal and her family. The latter's husband Atty. Jose Catunggal was also present in that meeting. He later on became instrumental in the drafting of the initial documents that were submitted as primary documents in the application for the creation of a new barrio.
 
Aside from the direly needed public services and facilities, the proponents also discussed the need to do away with the unpleasant and weird-sounding nomenclatures of the component sitios and to adopt the proposed changes;
:Sitio Tigbao (Sun-ok) to be renamed as Purok I
:Sitio Panuayon to be renamed as Purok II
:Sitio Kapangi-an to be renemaed as Purok III
:Sitio Cantumagsing to be renamed as Purok IV
:Sitio Bolho to be renamed as Purok V
They then proceeded to discussed about the name that the new barrio shall thenceforth be called and a quick suggestion that immediately met the approval and support of those who were present was that the new barrio shall be nominated as "Barrio San Jose".
 
This was easily pinpointed due to the unanimously felt need to devote the new barrio under the name of a Saint. It happened that one of the devotions practiced in that chapel wherein the first proponent's held their meeting is SENIOR SAN JOSE. Incidentally one of the well-respected lead personality in attendance during that meeting was a name-sake of the Patron Saint in the person of Atty. Jose Catunggal.
 
Thus the quorum decided via "Viva Voce" to call the new barrio as BARRI0 SAN JOSE and this became among others, as one of the proposals presented for adoption before the pre-listed COMELEC voters of that time. The signatures of voters were solicited to be affix opposite their respective names as listed on the "petition" that Atty. Catunggal drafted and submitted on November 4, 1971 for the creation of a new Barrio San Jose.
 
This said "petition" was then submitted to the City council of Cebu City, which under the sponsorship of the late Hon. Florencio Urot served as the main basis for City Ordinance No. 733. The said Ord. No. 733 was passed and thus confirmed the consolidation of the five (5) sitios and consequently legalized the creation and existence of the new BARRIO SAN JOSE that is separate and distinct from Barrio Talamban.
 
As a consequence for its creation, sometime on early months of 1972, a synchronized Barrio Election was mandated and was actually held. Several Public School Teachers were alternatively offered the task to chair the Board of Election Inspectors (BEI) but who declined for the simple reason that they were mostly constituents of Barrio Talamban and that they were also significantly affected by the creation of the new barrio. Finally, as an answered prayer of the proponents, the task was ultimately coursed through then Ms. LIlia Cogtas, a Talamban Elementary School Teacher who happened to have hailed from one of the sitios in the newly created barrio. The task was accepted and the Board of Election Tellers was appointed and constituted .
 
The composition of the Board of Election Tellers (BET) were as follows:
#Ms. Lilia Cogtas as the BET Chairperson;
#Mrs. Tomasa Nena Damaolao as the second member;
#Mr. Jesus C. Borces as the third member.
 
On January 5, 1972, the residents and officials of Barrio Talamban filed a case asking for issuance of a Restraining Order to prevent Barrio San Jose from holding their election on January 9, 1972. But Presiding Judge Francisco Tantuico denied their prayer.
 
The election was successfully held on January 9, 1972 with the three groups of registered political candidates for Barrio Captains with their respective line-up for Barrio councilmen were likewise certified.
 
First Group:  led by Simplicio Tudtud of Sitio Panuayon for Captain with complete line-up of barrio council candidates.
 
Second Group:  led by Leodigario Ferolino of Sitio Tigbao for Barrio Captain with complete line-up of Barrio Council Candidates.
 
Third Group:  led by Rolando Basirgo of Sitio Bolho for Barrio Captain with complete line-up of Barrio council candidates.
 
As the barrio Election progressed, the BEI were threatened by Atty. Pedro C. Son of Barrio Talamban. He particularly pinpointed the then Chairperson of the BEI, Ms. Lilia Cogtas to answer for a lawsuit if the conduct of the election would proceed. Equipped with legitimate appointments from the Provincial Governor, the BEI nevertheless proceeded with the holding of the election until it was finished.
 
HON. ROLANDO BASIRGO won in that election and became the First Barrio Captain Elect.

As the newly elected Officials of Barrio San Jose were sworn into office, the legal battle ensued. The elite leaders of Barrio Talamban made good of their threat. The Chairperson of the BEI, then Ms. Lilia Cogtas and the newly elected Barrio Officials were being sued.
 
The case for illegal conduct of election was docketed at Branch 14 RTC, Cebu City under the sala of the Hon. Judge Juan Y. Reyes. At this instance, it was the young Atty. Alvin Garcia of the Duterte Law Office, who happened to be a close friend of the appointed Barrio Secretary Mrs. Lorenza Borces, appeared as counsel in behalf of Barrio San Jose.     
 
Correspondingly, City Council sessions were held wherein the elite personalities and leaders of Barrio Talamban appeared to voice out their opposition and thus presented their contention that the creation of Barrio San Jose under Ordinance NO. 733 should be declared null and void. They mainly alleged that the creation of the new barrio was without the knowledge and permission of the mother Barrio of Talamban.
 
Fortunately, a strong defence was put up by elected Barrio Capt. Rolando Basirgo with the assistance of the appointed Barrio Secretary Mrs. Lorenza Borces which built up an irrefutable proof on the legality of the creation of the new barrio. They produced the verified photo copies of the signed petition asking for the creation of Barrio San Jose wherein the number one petitioner that affixed his signature was the then Barrio Captain of Talamban Hon. Eleuterio Minoza. The signature of the Talamban Barrio Captain during that time was taken as an unquestionable consent of Barrio Talamban that favored for the creation of Barrio San Jose.
 
As a result, the Cebu City Council passed City Ordinance No. 813 which is an amendment on the City Ordinance No. 733, defining the boundaries of the newly create Barrio San Jose, in terms of jurisdiction of all the adjacent barrios as well as the boundary that separates between the mother Barrio Talamban and this barrio. A portion of Sitio Tigbao was reconstituted back to Barrio Talamban in consideration for the location of the residence of it's Barrio Captain, the then Hon. Eleuterio Minoza that was accordingly specified and defined.
 
The newly elected barrio council under the First Barrio Captain Rolando Basirgo continued to discharge their functions as officials of the newly created Barrio San Jose and regularly held their council sessions in the makeshift Barrio Hall at the lot donated by Mrs. Ana Borgonia-Borces in Purok 1 (Sun-ok), San Jose. But sometime in the year 1976, Capt. Rolando Basirgo could not carry anymore of his functions due to work and transfer of residence to a far away place, thus he entrusted his duties and responsibilities to the Barrio Secretary Lorenza Borces and authorize her to attend ABC meetings and follow-up projects in his behalf. The Barrio Council did the same by executing an affidavit to that effect. Barrio San Jose under the watch of Mrs. Lorenza Borces slowly transformed into a lively progressive place as some important infrastructure projects were put in like the electrification project to the entire barrio and the opening of farm to market road to Purok 5, (Bolho) all the way to Barrio Pulangbato. Through Mrs. Borces, many investors were also brought in to buy pieces of properties which was the key to the setting foot of many institutional facilities and subdivision projects like the Kauswagan Community Hospital, FSPIF, CITE, OAD, MLhuillier Properties, Maryville Subdivisions and many others.
 
On May 17, 1982, a Second Synchronized Barrio Election was conducted and the Election Tellers prepared the Minutes of the Election and Election Results. Barrio Secretary and Acting Barrio Captain Lorenza Borces was elected the second Barrio Captain of Barrio San Jose.
 
On March 15, 1986, Presiding Judge Juan Y. Reyes issued the decision in favor of the creation of Barrio San Jose and upholds the barrio as a "de facto" unit recognized by the new government.
 
On June 11, 1992, The Court of Appeals XIII Division before Associate Justices Justo P. Torres Jr., Arturo B. Buena and Pacita Canizares-Nye in its Case No. CA-G.R. No. 16391-CV rendered the decision affirming the March 15, 1986 Appealed Decision of the Regional Trial Court, and accordingly upholds that Ordinance No. 733 as amended by Ordinance No. 813 providing for the creation of Barrio San Jose is valid and binding, being within the power of the City Council of Cebu to enact.
 
AND THUS this narrative on the history of the creation of BARANGAY SAN JOSE which humbly remains amenable and receptive to any vital information that were missed out in this narrative.
 
All submissions/contributions of additional information regarding the creation of BARANGAY SAN JOSE shall be gladly accepted, recorded and collated. This material shall be subjected to a process of verification and confirmation and shall ultimately be incorporated in the historical account for the creation of our barangay.

CHRONOLOGY OF EVENTS IN RELATION TO THE CREATION OF BARANGAY SAN JOSE:
 
 
 
November 4, 1971          Jose Catunggal wrote a letter to Hon. Florencio Urot then Acting
 
                                        City Mayor, the intent of residents of sitios Panuayon, Kapangian,
 
                                        Buljo, Tigbao and Cantomagsing to consolidate into one Barrio.
 
 
 
November 25, 1971        Cebu City Council in a Resolution No. 1770, approved Ordinance
 
                                        No. 733, Organizing five sitios of Barrio Talamban into a new
 
                                        Barrio to be called Barrio San Jose on the basis of the letter of
 
                                        Mr. Jose Catunggal. (said ordinance lapsed into law without
 
                                        Executive Approval as certified by Ribomapil Holganza, then
 
                                          Executive Secretary to the Mayor on December 22, 1971).
 
 
 
January 1, 1972              Provincial Governor Osmundo Rama appointed and constituted
 
                                        the Board of Election Tellers to conduct the election in the new
 
                                        barrio.
 
 
 
January 2, 1972              Nicetas Joaquino and other Barrio Officials and Pedro Son wrote
 
                                        a letter to City Council asking for reconsideration of the City
 
                                        Ordinance No. 733, and asking to be allowed to appear in one of
 
                                        the City Council's Sessions to explain their position.
 
 
 
January 5, 1972              Pedro Son, Eleuterio Minoza, Nicetas Joaquino, Jose Bontuyan,
 
                                        Gerardo Leyson, Rogelio Caminade, Bertoldo Bontilao, et al, filed
 
                                        a case in the Court of First Instance against Norberto Damaolao,
 
                                        Lorenza Borces, Rolando Basergo, et al in a Civil Case No.
 
                                        R-12511. Application for a Restraining Order before the sala of
 
                                        Judge Francisco Tantuico Jr.
 
 
 
January 6, 1972              Presiding Judge Francisco Tantuico Jr. of Branch VI of CFI,
 
                                        directed petitioners to present evidence to support their prayer
 
                                        for Restraining Order.
 
 
 
January 7, 1972              Hearing of the application for issuance of a restraining order was
 
                                        conducted. Defendants together with Atty. Alvin Garcia, were
 
                                        directed to appear and show cause why the Court Restraining
 
                                        Order should not be granted.
 
 
 
January 7, 1972              Pedro C. Son, Nicetas Joaquino and Jose Bontuyan wrote a letter
 
                                        to the Honorable Cebu Provincial Governor Osmundo Rama to
 
                                        issue an order to the Board of Election Tellers who were
 
                                        previously appointed by him to suspend the holding of the
 
                                        election of Barrio San Jose until further orders from the Governor.
 
                                        The said Memorandum was duly issued and received by
 
                                        Chairman Lilia Cogtas on the same date.
 
 
 
January 8, 1972              Hon. Judge Francisco Tantuico Jr. denied the prayer for the
 
                                        issuance of a restraining order.
 
 
 
January 9, 1972              First Election of Barrio San Jose was conducted and the Board of
 
                                        Election Tellers prepared the minutes of the election and the
 
                                        election returns.
 
 
 
February 4, 1972            City Council Secretary Leodegario C. Salazar wrote a letter to the
 
                                        Talamban Barangay Council, informing that their petition has been
 
                                        placed on the Agenda of Regular Session on February 14, 1972.
 
 
 
December 18, 1972        The Cebu City Council in a Resolution No. 1762 approved the
 
                                        City Ordinance No. 813 amending Section 1 of Ordinance
 
                                        No. 733 creating the three sitios in Talamban namely
 
                                        Kapangi-an, Buljo and Kantomagsing and a portion of sitio
 
                                        Panuayon into a new barrio to be known as Barrio San Jose and
 
                                        defining therein the boundary lines separating the mother barrio
 
                                        and the newly created barrio.
 
 
 
December 26, 1972        Court of First Instance Brancy VI Presiding Judge Francisco
 
                                        Tantuico Jr. issued an order dismissing the Civil Case No.
 
                                        R-12511 for lack of interest and failure to prosecute that case
 
                                        within a reasonable time by reason of failure of therein plaintiff
 
                                        to have summons served on the defendants through the sheriff
 
                                        assigned for proper service.
 
 
 
December 29, 1972        Plaintiff filed a Motion for Reconsideration of the Dismissal Order.
 
 
 
January 22, 1973            The Court denied the same.
 
 
 
June 8, 1975                  Barangay Talamban Council, resolved to authorize Atty. Pedro C.
 
                                        Son to represent Barangay Talamban as counsel.
 
 
 
  May 17, 1976                  Barrio Captain Rolando Basirgo cannot function anymore due to
 
                                        his work and transfer of residence, left his duties and
 
                                        respondibilities to the Barrio Secretary Lorenza Borces. He gave
 
                                        the authority to Lorenza to act on his behalf, to attend ABC
 
                                        meetings and to follow up the different projects. The Barrio
 
                                        Council then signed an affidavit authorizing Lorenza Borces to
 
                                        do the same.
 
 
 
August 11, 1976              Cebu City Mayor Eulogio Borres wrote a letter to Talamban
 
                                        Barangay Captain Jose Bontuyan that Barrio San Jose is a duly
 
                                        organized Barrio.
 
 
 
May 17, 1982                  The residents of Barangay San Jose held their Second Election
 
                                        and the Board of Election Tellers prepared the minutes of the
 
                                        Election and Election Returns. Mrs. Lorenza Borces was then
 
                                        elected the 2nd San Jose Barrio Captain.
 
 
 
June 20, 1983                A Pre-Trial Order was issued by the Court.
 
 
 
September 20, 1983      Hearing was conducted at which Lilia Cogtas, testified as a hostile
 
                                        witness.
 
 
 
November 21, 1983        Upon agreement of the parties, the court reset the hearing on
 
                                        January 20, 1984, at which date both parties would propose
 
                                        stipulation of facts afterwhich they shall close their respective
 
                                        cases and submit memorandum.
 
 
 
June 17, 1985                Both counsels of the Plaintiff and Respondents close their
 
                                        respective cases for the decision of the Court.
 
 
 
June 21, 1985                Both counsels officially submitted the above stipulation of facts in
 
                                        a Civil Case No. R-20503, Talamban Barangay Council
 
                                        represented by Atty Pedro C. Son VS City Council of Cebu
 
                                        represented by Fiscal Salvador C. Solima at the sala of Presiding
 
                                        Judge Juan Y. Reyes of the Regional Trial Court Branch XIV.
 
 
 
March 15, 1986              Presiding Judge Juan Y. Reyes issued the decision in favor of City
 
                                        of Cebu and the Barangay San Jose, and upholds its creation as

April 4, 1986                  Atty Pedro C. Son, counsel of Talamban Barangay Council not
 
                                        satisfied with the decision rendered by the Regional Trial Court,
 
                                        appealed the case to Intermediate Appellate Court, Manila on
 
                                        questions of facts and law.
 
 
 
April 8, 1986                  Presiding Judge Juan Y. Reyes ordered the transmittal of the
 
                                        entire original records of the case to the Intermediate Appellate
 
                                        Court with all pages thereof prominently numbered consecutively.

SAN Jose’s neophyte village chief is the richest Cebu City barangay captain for the second straight year.
 
From a net of P17 million last year, Barangay Captain Merinisa Arinasa’s statement of assets, liabilities and net worth (SALN) this year showed an increase of around P3 million.
 
She listed her real properties as totaling P17.15 million, which include inherited agricultural land, house and lot, three residential lots, and a piece of property in Tabuelan town.
 
She owed banks P3.06 million but has P6.44 million in personal and other properties, which included four vehicles and heavy equipment–two backhoes, three dumptrucks, two mini-trucks, and a payloader that were all bought in 2008.
 
The Arinasas are into construction and sand and gravel extraction.
 
In an interview last year when Sun.Star Cebu published a feature of her, Arinasa, now 55, said her properties, which she said were acquired through “guts, risks, and honesty,” are all declared in her SALN.

Next to Arinasa in terms of net worth is Inayawan Barangay Captain Rustico Ignacio, who said in his SALN that he is worth P15.085 million and without any liabilities.
 
He indicated exactly the same amount in his SALN last year.
 
Ignacio, who is into the scrap-buying business, among other ventures, owns land and buildings in Inayawan, Poblacion Pardo, Tejero, T. Padilla in Cebu City; Lapu-Lapu City; and in Olango Island.
 
The third richest Cebu City Barangay Captain is Domingo Lopez of Tinago, who has P14.745 million worth of properties, including land along M. J. Cuenco Ave. and Barangay Bacayan in Cebu City, Sogod town, Talisay City, and Masbate province totaling P11.1 million. He also has three vehicles worth P3.645 million.
 
Guadalupe Barangay Captain Eugenio Faelnar is the fourth richest, with P12.608 million worth of jewelry, five residences, three vehicles, and cash in the bank. He, however, has liabilities of P600,000.
 
Next to Faelnar is Day-as Barangay Captain Rey Cañada, who has P10.48 million in assets and P100,000 in liabilities.
 
Cañada reported inherited residential and agricultural lots totaling P4.8 million and P10.48 million worth of personal properties, which include audio equipment and three vehicles.
 
Rounding up the top 10 are Quiot’ Vicente Ramos (P9.07 million, with P350,000 in liabilities), Tejero’s Jessielou Cadungog (P8.2 million, with P80,000 in liabilities), Buhisan’s Rustica Asid (P6.141 million), Sambag I’s Jerry Guardo (P6.42 million, with P400,000 in liabilities), and Banilad’s Mary Luz Tabar (P5.497 million).
 
Like Ignacio, Asid declared total assets exactly like what she indicated in her 2008 SALN.
 
Excluding Faelnar, Ramos, Guardo, and Asid, all the 10 richest barangay captains of Cebu City are first-timers in their job.
 
The list did not take into account Talamban Barangay Captain Alvin Arcilla’s assets, who has personal and other properties worth P820,000.
 
While he indicated real properties in his SALN, the value of a house and lot each in Talamban and in Barangay Pit-os; an Internet café; a lot each in Sitio Tag-ube and in Barangay Pit-os; and a factory in Tawason, were not indicated.
 
On the other hand, Sta. Cruz’s Jerome Lim replaced Guba’s Renerio Limotan as the poorest barangay captain.
 
Limotan, who declared his wristwatch worth P2,200 and a class ring worth P4,000 as his only assets last year, now has P34,700 in personal and other properties. He, however, said he has a P60,000 loan with the Cebu CFI Cooperative.
 
Lim, who reported P36,000 worth of personal and other properties, has a P150,000 loan with the CFI.
 
Parian Barangay Captain Mark Balaga, single, has the lowest assets with just P21,000 in personal properties.
 
He only owns a cellphone worth P9,000; watch, P3,000; and an airconditioning unit worth P21,000, and owed the CFI
P100,000 in loans.
 
The SALN is a financial statement that public officials are required to submit to the Office of the Ombudsman every year.
 
Republic Act 6713, or the Code of Conduct and Ethical Standards for Public Officials and Employees, requires them to submit a declaration, under oath, of their assets, liabilities, net worth and financial and business interests.
 
They are also mandated to declare the assets of spouses and unmarried children under 18 years old who are living with the family. The names of relatives working in the government should also appear in their SALNs.
 
The SALN helps the anti-graft office keep track of any drastic change in the net worth of public officials or unexplained wealth.
 
Many “lifestyle checks” begin when questions are raised about SALN reports.

The Philippines has been a "decentralized" form of government since 1991, contrary to what most Filipinos think. Ever since the creation of Republic Act 7160, each LGU is responsible for its own domain. Even the smallest LGU the barangay creates its own Budget. It is not dependent on handouts from the city, municipality or province. "IMPERIAL MANILA IS A MYTH!", it does not exist anymore. The Philippine budget formulation system is not centralized. "Budgetary planning has been DECENTRALIZED since 1991". It is the responsibility of each LGU to submit their budgetary needs for review. Failure to submit is the problem.

San Jose is located at the northern part of Cebu City around 14 kms from the Cebu City Hall. It is bounded by Barangay Talamban at the south, Barangay Bacayan and Butuanon River at the East, Barangay Pulangbato at the North and Barangay Budla-an at the West. It has around 300 has jurisdictional lot area and composed mostly of mountainous and hilly terrain. Around 14% of its total land area is of plain terrain and occupied by households and religious structures. Thus the remaining 85% of total land area is idle and have no road accessibility. The barangay is classified as Rural Residential Zone by the City Assessors Office and most of its locators are of religious communities, thus not a few times was it described as the little Jerusalem in the Philippines.........

HISTORY ON THE CREATION OF BARANGAY SAN JOSE By Barangay SanJose on Saturday, August 8, 2015 at 6:30 PM

(Excerpt from the accounts of expert witnesses who were present and who have participated in the process of the creation of Barangay San Jose) - First Barrio Captain Rolando Basirgo, Public School Teacher Ms. Lilia C. Bontuyan, Lupon Coordinator Jesus Borces and Brgy Councilor Edgardo Borces.

BARRIO SAN JOSE, before its creation into a new barrio, was considerably a remote hilly terrain comprised by the five (5) sitios of Barrio Talamban, namely: 1) Sitio Panuayon, 2) Sitio Kapangi-an, 3) Sitio Kantumagsing, 4) Sitio Tigbao (Sun-ok) and 5) Sitio Bolho. A substantially populated community that is geographically situated on the outskirts of Barrio Talamban. Unfortunately, it has no roads , electricity and piped water system due to its a far-off location that can only be accessed through existing footpaths or carabao cart trails. The people communing in this area felt being neglected by the leadership and officials of it's original barrio (TALAMBAN) in terms of public services and facilities. The concentration of projects and developments like roads, thoroughfare, waterworks system and electricity were then only devoted on the "poblacion" plains of the Barrio Center. Sometime in 1971, Mrs. Lorenza Borces with her close friend and companion, Mrs. Melitona Colina, initiated the idea of consolidating the five (5) sitios to form into one barrio that is separate and distinct from that of Barrio Talamban under the following justifications;

To enable the new barrio to secure for itself new roads and other public service facilities, precisely for the progress and enhancements to the lives of it's constituents;
To secure distinct governmental budget appropriations for health services, education, as well as other economic incentives under the city-wide development plan of the Cebu City government.
To obtain faster development for basic needs such as public roads, electricity and water system.

These two proponents initiated the holding of the historical meeting among concerned constituents in a chapel at "Sitio Panuayon" that was owned by the late Agapita "Pitang" Tudtud-Catunggal and her family. The latter's husband Atty. Jose Catunggal was also present in that meeting. He later on became instrumental in the drafting of the initial documents that were submitted as primary documents in the application for the creation of a new barrio.

Aside from the direly needed public services and facilities, the proponents also discussed the need to do away with the unpleasant and weird-sounding nomenclatures of the component sitios and to adopt the proposed changes;

Sitio Tigbao (Sun-ok) to be renamed as Purok I
Sitio Panuayon to be renamed as Purok II
Sitio Kapangi-an to be renemaed as Purok III
Sitio Cantumagsing to be renamed as Purok IV
Sitio Bolho to be renamed as Purok V

They then proceeded to discussed about the name that the new barrio shall thenceforth be called and a quick suggestion that immediately met the approval and support of those who were present was that the new barrio shall be nominated as "Barrio San Jose".

This was easily pinpointed due to the unanimously felt need to devote the new barrio under the name of a Saint. It happened that one of the devotions practiced in that chapel wherein the first proponent's held their meeting is SENIOR SAN JOSE. Incidentally one of the well-respected lead personality in attendance during that meeting was a name-sake of the Patron Saint in the person of Atty. Jose Catunggal.

Thus the quorum decided via "Viva Voce" to call the new barrio as BARRI0 SAN JOSE and this became among others, as one of the proposals presented for adoption before the pre-listed COMELEC voters of that time. The signatures of voters were solicited to be affix opposite their respective names as listed on the "petition" that Atty. Catunggal drafted and submitted on November 4, 1971 for the creation of a new Barrio San Jose.

This said "petition" was then submitted to the City council of Cebu City, which under the sponsorship of the late Hon. Florencio Urot served as the main basis for City Ordinance No. 733. The said Ord. No. 733 was passed and thus confirmed the consolidation of the five (5) sitios and consequently legalized the creation and existence of the new BARRIO SAN JOSE that is separate and distinct from Barrio Talamban.

As a consequence for its creation, sometime on early months of 1972, a synchronized Barrio Election was mandated and was actually held. Several Public School Teachers were alternatively offered the task to chair the Board of Election Inspectors (BEI) but who declined for the simple reason that they were mostly constituents of Barrio Talamban and that they were also significantly affected by the creation of the new barrio. Finally, as an answered prayer of the proponents, the task was ultimately coursed through then Ms. LIlia Cogtas, a Talamban Elementary School Teacher who happened to have hailed from one of the sitios in the newly created barrio. The task was accepted and the Board of Election Tellers was appointed and constituted .

The composition of the Board of Election Tellers (BET) were as follows:

  1. Ms. Lilia Cogtas as the BET Chairperson;
  2. Mrs. Tomasa Nena Damaolao as the second member;
  3. Mr. Jesus C. Borces as the third member.

On January 5, 1972, the residents and officials of Barrio Talamban filed a case asking for issuance of a Restraining Order to prevent Barrio San Jose from holding their election on January 9, 1972. But Presiding Judge Francisco Tantuico denied their prayer.

The election was successfully held on January 9, 1972 with the three groups of registered political candidates for Barrio Captains with their respective line-up for Barrio councilmen were likewise certified.

First Group: led by Simplicio Tudtud of Sitio Panuayon for Captain with complete line-up of barrio council candidates.

Second Group: led by Leodigario Ferolino of Sitio Tigbao for Barrio Captain with complete line-up of Barrio Council Candidates.

Third Group: led by Rolando Basirgo of Sitio Bolho for Barrio Captain with complete line-up of Barrio council candidates.

As the barrio Election progressed, the BEI were threatened by Atty. Pedro C. Son of Barrio Talamban. He particularly pinpointed the then Chairperson of the BEI, Ms. Lilia Cogtas to answer for a lawsuit if the conduct of the election would proceed. Equipped with legitimate appointments from the Provincial Governor, the BEI nevertheless proceeded with the holding of the election until it was finished.

HON. ROLANDO BASIRGO won in that election and became the First Barrio Captain Elect.

The FIRST BARRIO COUNCILORS were elected in this particular order:

  1. Pascual Opigal - Bolho
  2. Eufemio Minoza - Tigbao
  3. Nicolas Borgonia - Tigbao
  4. Rogidilio Arinasa - Capangi-an
  5. Fructuso Seno - Bolho
  6. Robinson Minoza - Bolho
  • The First Appointed Barrio Secretary was Mrs. Lorenza Borces
  • The First Appointed Barrio Treasurer was Mrs. Tomasa Nena Damaolao

As the newly elected Officials of Barrio San Jose were sworn into office, the legal battle ensued. The elite leaders of Barrio Talamban made good of their threat. The Chairperson of the BEI, then Ms. Lilia Cogtas and the newly elected Barrio Officials were being sued.

The case for illegal conduct of election was docketed at Branch 14 RTC, Cebu City under the sala of the Hon. Judge Juan Y. Reyes. At this instance, it was the young Atty. Alvin Garcia of the Duterte Law Office, who happened to be a close friend of the appointed Barrio Secretary Mrs. Lorenza Borces, appeared as counsel in behalf of Barrio San Jose.

Correspondingly, City Council sessions were held wherein the elite personalities and leaders of Barrio Talamban appeared to voice out their opposition and thus presented their contention that the creation of Barrio San Jose under Ordinance NO. 733 should be declared null and void. They mainly alleged that the creation of the new barrio was without the knowledge and permission of the mother Barrio of Talamban.

Fortunately, a strong defence was put up by elected Barrio Capt. Rolando Basirgo with the assistance of the appointed Barrio Secretary Mrs. Lorenza Borces which built up an irrefutable proof on the legality of the creation of the new barrio. They produced the verified photo copies of the signed petition asking for the creation of Barrio San Jose wherein the number one petitioner that affixed his signature was the then Barrio Captain of Talamban Hon. Eleuterio Minoza. The signature of the Talamban Barrio Captain during that time was taken as an unquestionable consent of Barrio Talamban that favored for the creation of Barrio San Jose.

As a result, the Cebu City Council passed City Ordinance No. 813 which is an amendment on the City Ordinance No. 733, defining the boundaries of the newly create Barrio San Jose, in terms of jurisdiction of all the adjacent barrios as well as the boundary that separates between the mother Barrio Talamban and this barrio. A portion of Sitio Tigbao was reconstituted back to Barrio Talamban in consideration for the location of the residence of it's Barrio Captain, the then Hon. Eleuterio Minoza that was accordingly specified and defined.

The newly elected barrio council under the First Barrio Captain Rolando Basirgo continued to discharge their functions as officials of the newly created Barrio San Jose and regularly held their council sessions in the makeshift Barrio Hall at the lot donated by Mrs. Ana Borgonia-Borces in Purok 1 (Sun-ok), San Jose. But sometime in the year 1976, Capt. Rolando Basirgo could not carry anymore of his functions due to work and transfer of residence to a far away place, thus he entrusted his duties and responsibilities to the Barrio Secretary Lorenza Borces and authorize her to attend ABC meetings and follow-up projects in his behalf. The Barrio Council did the same by executing an affidavit to that effect. Barrio San Jose under the watch of Mrs. Lorenza Borces slowly transformed into a lively progressive place as some important infrastructure projects were put in like the electrification project to the entire barrio and the opening of farm to market road to Purok 5, (Bolho) all the way to Barrio Pulangbato. Through Mrs. Borces, many investors were also brought in to buy pieces of properties which was the key to the setting foot of many institutional facilities and subdivision projects like the Kauswagan Community Hospital, FSPIF, CITE, OAD, MLhuillier Properties, Maryville Subdivisions and many others.

On May 17, 1982, a Second Synchronized Barrio Election was conducted and the Election Tellers prepared the Minutes of the Election and Election Results. Barrio Secretary and Acting Barrio Captain Lorenza Borces was elected the second Barrio Captain of Barrio San Jose.

On March 15, 1986, Presiding Judge Juan Y. Reyes issued the decision in favor of the creation of Barrio San Jose and upholds the barrio as a "de facto" unit recognized by the new government.

On June 11, 1992, The Court of Appeals XIII Division before Associate Justices Justo P. Torres Jr., Arturo B. Buena and Pacita Canizares-Nye in its Case No. CA-G.R. No. 16391-CV rendered the decision affirming the March 15, 1986 Appealed Decision of the Regional Trial Court, and accordingly upholds that Ordinance No. 733 as amended by Ordinance No. 813 providing for the creation of Barrio San Jose is valid and binding, being within the power of the City Council of Cebu to enact.

AND THUS this narrative on the history of the creation of BARANGAY SAN JOSE which humbly remains amenable and receptive to any vital information that were missed out in this narrative.

All submissions/contributions of additional information regarding the creation of BARANGAY SAN JOSE shall be gladly accepted, recorded and collated. This material shall be subjected to a process of verification and confirmation and shall ultimately be incorporated in the historical account for the creation of our barangay.

CHRONOLOGY OF EVENTS IN RELATION TO THE CREATION OF BARANGAY SAN JOSE:


November 4, 1971 Jose Catunggal wrote a letter to Hon. Florencio Urot then Acting

                                       City Mayor, the intent of residents of sitios Panuayon, Kapangian,
                                       Buljo, Tigbao and Cantomagsing to consolidate into one Barrio.


November 25, 1971 Cebu City Council in a Resolution No. 1770, approved Ordinance

                                        No. 733, Organizing five sitios of Barrio Talamban into a new
                                        Barrio to be called Barrio San Jose on the basis of the letter of
                                        Mr. Jose Catunggal. (said ordinance lapsed into law without
                                        Executive Approval as certified by Ribomapil Holganza, then 
                                         Executive Secretary to the Mayor on December 22, 1971).


January 1, 1972 Provincial Governor Osmundo Rama appointed and constituted

                                       the Board of Election Tellers to conduct the election in the new
                                       barrio.


January 2, 1972 Nicetas Joaquino and other Barrio Officials and Pedro Son wrote

                                       a letter to City Council asking for reconsideration of the City
                                       Ordinance No. 733, and asking to be allowed to appear in one of
                                       the City Council's Sessions to explain their position.


January 5, 1972 Pedro Son, Eleuterio Minoza, Nicetas Joaquino, Jose Bontuyan,

                                       Gerardo Leyson, Rogelio Caminade, Bertoldo Bontilao, et al, filed
                                       a case in the Court of First Instance against Norberto Damaolao,
                                       Lorenza Borces, Rolando Basergo, et al in a Civil Case No.
                                       R-12511. Application for a Restraining Order before the sala of
                                       Judge Francisco Tantuico Jr.


January 6, 1972 Presiding Judge Francisco Tantuico Jr. of Branch VI of CFI,

                                       directed petitioners to present evidence to support their prayer
                                       for Restraining Order.


January 7, 1972 Hearing of the application for issuance of a restraining order was

                                       conducted. Defendants together with Atty. Alvin Garcia, were 
                                       directed to appear and show cause why the Court Restraining 
                                       Order should not be granted.


January 7, 1972 Pedro C. Son, Nicetas Joaquino and Jose Bontuyan wrote a letter

                                       to the Honorable Cebu Provincial Governor Osmundo Rama to
                                       issue an order to the Board of Election Tellers who were
                                       previously appointed by him to suspend the holding of the
                                       election of Barrio San Jose until further orders from the Governor.
                                       The said Memorandum was duly issued and received by
                                       Chairman Lilia Cogtas on the same date.


January 8, 1972 Hon. Judge Francisco Tantuico Jr. denied the prayer for the

                                       issuance of a restraining order.


January 9, 1972 First Election of Barrio San Jose was conducted and the Board of

                                       Election Tellers prepared the minutes of the election and the
                                       election returns.


February 4, 1972 City Council Secretary Leodegario C. Salazar wrote a letter to the

                                       Talamban Barangay Council, informing that their petition has been
                                       placed on the Agenda of Regular Session on February 14, 1972.


December 18, 1972 The Cebu City Council in a Resolution No. 1762 approved the

                                       City Ordinance No. 813 amending Section 1 of Ordinance 
                                       No. 733 creating the three sitios in Talamban namely 
                                       Kapangi-an, Buljo and Kantomagsing and a portion of sitio 
                                       Panuayon into a new barrio to be known as Barrio San Jose and 
                                       defining therein the boundary lines separating the mother barrio 
                                       and the newly created barrio.

                                       Tantuico Jr. issued an order dismissing the Civil Case No.
                                       R-12511 for lack of interest and failure to prosecute that case
                                       within a reasonable time by reason of failure of therein plaintiff
                                       to have summons served on the defendants through the sheriff
                                       assigned for proper service.


December 29, 1972 Plaintiff filed a Motion for Reconsideration of the Dismissal Order.


January 22, 1973 The Court denied the same.


June 8, 1975 Barangay Talamban Council, resolved to authorize Atty. Pedro C.

                                       Son to represent Barangay Talamban as counsel.


 May 17, 1976                  Barrio Captain Rolando Basirgo cannot function anymore due to 
                                       his work and transfer of residence, left his duties and 
                                       respondibilities to the Barrio Secretary Lorenza Borces. He gave 
                                       the authority to Lorenza to act on his behalf, to attend ABC 
                                       meetings and to follow up the different projects. The Barrio 
                                       Council then signed an affidavit authorizing Lorenza Borces to 
                                       do the same.


August 11, 1976 Cebu City Mayor Eulogio Borres wrote a letter to Talamban

                                       Barangay Captain Jose Bontuyan that Barrio San Jose is a duly
                                       organized Barrio.


May 17, 1982 The residents of Barangay San Jose held their Second Election

                                       and the Board of Election Tellers prepared the minutes of the
                                       Election and Election Returns. Mrs. Lorenza Borces was then
                                       elected the 2nd San Jose Barrio Captain.


June 20, 1983 A Pre-Trial Order was issued by the Court.


September 20, 1983 Hearing was conducted at which Lilia Cogtas, testified as a hostile

                                       witness. 


November 21, 1983 Upon agreement of the parties, the court reset the hearing on

                                       January 20, 1984, at which date both parties would propose
                                       stipulation of facts afterwhich they shall close their respective
                                       cases and submit memorandum.


June 17, 1985 Both counsels of the Plaintiff and Respondents close their

                                       respective cases for the decision of the Court.


June 21, 1985 Both counsels officially submitted the above stipulation of facts in

                                       a Civil Case No. R-20503, Talamban Barangay Council
                                       represented by Atty Pedro C. Son VS City Council of Cebu
                                       represented by Fiscal Salvador C. Solima at the sala of Presiding
                                       Judge Juan Y. Reyes of the Regional Trial Court Branch XIV.


March 15, 1986 Presiding Judge Juan Y. Reyes issued the decision in favor of City

                                       of Cebu and the Barangay San Jose, and upholds its creation as
                                       certainly a de facto local unit impliedly recognized by the new
                                       government. 


April 4, 1986 Atty Pedro C. Son, counsel of Talamban Barangay Council not

                                       satisfied with the decision rendered by the Regional Trial Court,
                                       appealed the case to Intermediate Appellate Court, Manila on
                                       questions of facts and law.


April 8, 1986 Presiding Judge Juan Y. Reyes ordered the transmittal of the

                                       entire original records of the case to the Intermediate Appellate
                                       Court with all pages thereof prominently numbered consecutively.


June 11, 1992 The Court of Appeals XIII Division before Associate Justices Justo

                                       P. Torres Jr., Arturo B. Buena and Pacita Canizares-Nye in its
                                       Case No. CA-G.R. No. 16391-CV rendered the decision affirming
                                       the March 15, 1986 Appealed Decision of the Regional Trial
                                       Court, and accordingly upholds that Ordinance No. 733 as
                                       amended by Ordinance No. 813 providing for the creation of
                                       Barrio San Jose is valid and binding, being within the power of
                                       the City Council of Cebu to enact.
